Forming a non profit organization in Virginia is multi-step procedure that will include:
Choosing a Name and Checking for Availability - The name you choose must be unique from any other registered name on file with the Secretary of State and must contain the term “Corporation”, “Incorporated” or “Limited”.
Preparing the Articles of Incorporation - The next step is preparing articles of incorporation document and submitting it to the Clerk of The State Corporation Commission along with a filing fee of $75. The articles of incorporation must include the specific language of the IRS in order to obtain 501(c) (3) tax-exempt status. This status allows non profit corporations to accept grants from public and private entities, issue tax-exempt certificates to contributors. It also exempts them from paying federal and state income taxes on profits generated by the corporation.
The articles of incorporation must contain the name of the corporation, its purpose, name, address and verified signature of the initial incorporator(s) and the name and street address of the registered agent. Other formation procedures require:
